[Subject: Request for an urgent appointment of an Administrator at Elite Empire CHS., Balewadi to bring the functioning of the said society back on track.]


 


Dear Sir,


We, the undersigned society members & flat purchasers of the Elite Empire Co-op. Hsg. Soc., S. No. 7 & 8 (Pt), Balewadi, Taluka Haveli, Pune - 411045, seek to bring to your kind attention the dire situation at the aforesaid co-op. housing society [CHS] and request that an Administrator be appointed with immediate effect to salvage the society affairs back from its current day state.


Facts about Elite Empire CHS:


1>     The developers of the Elite Empire CHS. are M/s. Elite Landmarks Pvt. Ltd. [formerly known as Elite Erectors Pvt. Ltd.], with the head office located at Elite House, 93 B/6, Senapati Bapat Rd., Pune - 411053.


2>     The Elite Empire CHS is a society with 188 registered members, 113 unregistered members and 24 vacant flats. The overall residential population at the society is approximated to be over 1500 people.


3>     The Elite Empire CHS has been registered on 18/5/2006. The Registration no. is PNA / PNA / (4) HSG (TC) 7932 2006-2007.


4>     To the best of our knowledge, the following are the primary office-bearers of the Elite Empire CHS:


a.       Mr.Gajendra Patil - Chairman


b.      Mr. Parag Patil - Secretary


c.       Mr. Satish Warade – Treasurer


 


5>     The current Chairman and the current Secretary are also the primary developers of the Elite Empire CHS.


6>     To the best of our knowledge, none of the current office-bearers have executed an M-20 Indemnity bond, as mandated by the Maharashtra Co-operative Societies Act, 1960.




 


Grievances:


The society residents are suffering due to the following violations committed by the current office-bearers vis-a-vis the Maharashtra Co-operative Societies Act, 1960:


1.       As per the law, the developers of the society are required to call for a meeting of all the society members and flat purchasers within a period of 3 months from the date of formation of the Society [i.e. 18/5/2006]. The primary objective of this meeting is to call for the formation of a Provisional Committee and for the developers to hand over the society affairs and accounts over to this Provisional Committee. However, to date, no such meeting has been called for nor has such a Provisional Committee been formed.


2.       To date, none of the society members have been issued a share certificate related to the membership of the society, although the amount for the same has already been collected from most of the flat purchasers.


3.       The society members have, in the past, unearthed a number of gross violations in the audited balance sheets of the society for the past financial years and as a result of this, the builders had to concede and pay back an amount Rs. 15 lakhs back into the society account. Of this amount, an amount of Rs. 5 lakhs is still due to be paid by the builders. Several learned members in the society also rightly pointed out that the audit process conducted was totally inappropriate and the balance sheet provided could not have been such audited by a competent auditor.


4.       It has come to our attention that several employees of the society are being coerced into working outside the society at the other developmental activities of the developers during the official hours of the society office. These instructions are being carried out by employees of Elite Landmarks Pvt. Ltd., who have absolutely no business in meddling in the affairs of the society or with dealing with the employees of the society. All this can only be carried out at the behest of the developers. Such misappropriation of the work efforts of the society's employees has been happening in the past and has been pointed out to the current office-bearers in the past, as well.


5.       As per the PMC regulations, the society of the size of Elite Empire CHS. ought to be provided with a 13 inch PMC water connection. However, to the best of our knowledge, to date, we have been given only 6.5 inch of water connection. Even with this 50% water connection, the PMC is not supplying water commensurate with the full capacity of the 6.5 inch connection. The builders have not taken any effort to ensure that their promise of providing adequate water connections from the PMC is met. Due to this, the society continues to face an expenditure of over Rs. 2,00,000 every month just to supplement the grossly inadequate PMC water supply with costly water tanker facilities.


6.       It has come to our attention that the society account is fast dropping to zero and that several vendors servicing the society, such as the water tanker services and the security services, have not been paid for the last several months. At the same time, the employees of the society have also not been paid their salaries this month. Owing to this, the society is very likely to lose all the above-mentioned services by the end of March, 2009.


7.       There are several long-standing commitments to many of the society members that have not been met by the builders due to which many of such members have refused to pay their due maintenance charges. In the past, the builders have not taken the effort to proactively sort out these issues with these society members. To the best of our knowledge, this is still the status quo wrt. this issue.


In the past, we have approached the builders in several fora - by e-mail, by open meetings, by letters via registered post - seeking transparency in these matters and for the quick resolution of the aforesaid growing list of issues at the society. However, to date, our numerous requests seem to have fallen on deaf ears. As a result, to this day, we, the undersigned, do not have any inkling of the concrete plan of the handover of the society by the developers.


We are also aware that your office has issued two show-cause notices already to the current office-bearers and have summoned them to your office to provide an explanation for the gross irregularities


already detected by your office. We are also aware that similar letters have also been issued by the Certified Auditor associated with your office questioning the audit reports submitted/not submitted by the current office-bearers.


Based on all the above points, we earnestly request you to exercise the powers vested in your post and urgently issue an order for the appointment of an Administrator to the aforesaid society who will supervise the long overdue process of the handover of the society from the developers to the society, as stipulated in The Maharastra Co-operative Societies Act, 1960.


Failing this, the aforesaid society of 1500 + residents is in urgent danger of suffering from the lack of basic necessities such as water, electricity and security with immediate effect for no fault of theirs.

  francis my society was registered many years back,but they dont maintain any rule and regulation at all, the owner of the flat give it to tenant on rent,and they dont submit any documents to the society, nor the society takes any initative to do that,no police verification is also done,and the tenant creat a nuisance,use verbal language,make noise after deadline hours in the evening,mentally harras, the neighbour,what can be done in this case you can email me on francis_maria76@hotmail.com please suggest
  NARESH R.SALVI my problem is that my father has expired in 2007 and the flat that we stay in was in joint account with my mother's name. My mother wants to add my name in the flat. She had submitted a request letter to the society on 09-09-2009 for addition of my name alonwith a zerox copy of death certificate and nomination certificate. After two years the society wants following additional documents. 1. Noc from my sisters. 2. If that is not possible than they have to personnelly come and sign documents or 3. We have to get their signature verified from bank. Can you please guide me on the above matter. Further, 1. My father has not left a will. 2. I am ready to give "noc" from my sisters which i am already holding. 3. They want my sisters to come down and sign in front of them. 4. My problem is one sister is in usa who came down in july, 2011 and another in gujarat who can come down. I seek your advice on the above matter.

  mani dear friend, water, electricity are everybodys problems. why blame the builder? and now from last 2 years the builder has handed over it to the society and it is managed by us. I see no change no change. It was better when it was with the builder atleast maintained. It is the municipal corporation who has to provide you with this facilities. The builder has already provided us the infrastructure.

We are going through a lot of problems like water shortage, thefts, no maintainance of the Society facilities like swimming pool and Gym and many others. Quick action should be taken atleast to provide the basic necessities to the society residents. A lot of efforts on this have borne no fruit, we request your intervention to help us solve this problem.
